- Does Georgia have an estate tax? I'm Sarah Siedentopf. I'm an estate planning and probate attorney in Atlanta, Georgia. No, Georgia does not have an estate tax. There could be a federal estate tax that applies to your situation, even though there is not a state one here in Georgia. So, if someone passes away living in Georgia, they are subject to federal taxes. However, there is an exemption, which means that up until I meet the exemption amount, I am not taxed. And right now, the exemption is a little over 12 million per person. So, I can give away at my death a little over 12 million before I run into any federal taxes. After that, they are taxed at a pretty hefty percentage, but we don't specifically have estate taxes in Georgia.
